This Legal Notice and Conditions of Use regulate the access, navigation and use of this Website, without prejudice that GLOBALMAR reserves the right to modify the presentation, configuration and content of the Website, as well as the conditions required for its access and/or use. The access and use of the contents of the Website after the entry into force of its modifications or changes implies the acceptance of the same.
Likewise, users are informed about their rights and obligations in relation to the contents displayed through the Web Site, logos and trademarks used, as well as the responsibilities that may arise from accessing the Web Site.
4. WEBSITE ACCESS AND REGISTRATION
Access to the contents of the Web Site is completely free and does not require prior registration, notwithstanding that there may be particular sections or services that require prior registration. In the latter case, the user will be informed in advance, and must accept the corresponding conditions for contracting said service.
Access to the Website by minors is prohibited. However, in case of access to the Website and registration by a minor, it will be presumed that such access has been made with prior and express authorization of their parents, guardians or legal representatives, without prejudice that GLOBALMAR reserves the right to carry out as many verifications and checks as it deems appropriate.
Under no circumstances GLOBALMAR will be responsible for the veracity of the registration data provided by the users, so each of them will be solely responsible for the adequacy, accuracy and precision of the information provided to GLOBALMAR or, otherwise, for the possible consequences that may arise from the lack of quality of the data.
4.1 User registration requirements
However, the User may also make purchases through the Website without having to create his own account. To do so, you must complete the order form in full, i.e., indicating not only the data relating to the purchase, but also your identification and contact details.
It is an essential requirement to register as a user to be over eighteen (18) years of age and to provide all the required information through the Website. The registered user assumes that his/her user account is personal and non-transferable.
Every registered user will have an access password, which will be personal, non-transferable, and will be valid for a limited period of time. This password must meet minimum length and security requirements. The user will be able to modify or recover this password at any time, following the procedure provided in the Website. In no case GLOBALMAR will have direct access to such password except for the provision of the access service to the Website to the users. This password will remain in GLOBALMAR's systems encrypted to ensure its conservation and avoid unauthorized access by third parties.
By virtue of the above, it is the user's obligation to immediately notify GLOBALMAR any fact that allows the improper use of the identifiers and/or passwords, such as theft, loss, or unauthorized access to them, in order to proceed to their immediate cancellation. As long as such facts are not communicated, GLOBALMAR will be exempted from any liability that may arise from the misuse of identifiers or passwords by unauthorized third parties.
The legal relationship derived from the registration as a User of the Website has an indefinite duration. Any of the parties may terminate or suspend this contractual relationship unilaterally at any time and without any other cause than their will in that sense, without prejudice to the obligations arising from the formalization of orders prior to the termination of the relationship. The User may unilaterally exercise the termination right through the account cancellation process by contacting GLOBALMAR through the contact spaces provided in the Website and/or through the email address firstname.lastname@example.org.
In any case, once the cancellation has been made, the user may request a new registration, except for GLOBALMAR's right not to admit such registration in the specific cases specified in the clause called "Website Rules of Use", or in case of conflict or controversy between the parties, which has not been resolved or which has ended with recognition of fault or negligence of the user and/or damage to GLOBALMAR, its collaborators and associates or its users, clients or potential clients.

Nevertheless, GLOBALMAR declares that it has adopted all necessary measures, within its possibilities and the state of the art, to guarantee the functioning of the Website and to minimize system errors, both from a technical and legal and organizational point of view.
If the User becomes aware of the existence of any illicit or illegal content, contrary to the law or that could imply an infringement of third party rights, he/she must immediately notify GLOBALMAR so that it can proceed to the adoption of the appropriate measures.
GLOBALMAR shall not be responsible for the veracity, integrity or updating of the information published in the Website coming from external sources and shall not be liable for hypothetical damages that may arise from the use of such information.
7. LINK POLICY
7.1. LINKS TO OTHER WEBSITES
In case the Website includes links to other web pages through buttons, links, banners or embedded contents, GLOBALMAR informs that these are directly managed by third parties, GLOBALMAR does not have the human or technical means to know in advance and/or control and/or approve all the information, contents, products or services provided by other platforms to which links may be established from the Website.
Consequently, GLOBALMAR shall not be liable for any aspect related to the platform or web page to which a link may be established from the Website, specifically, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general.
In this sense, if the users have effective knowledge that the activities developed through these third party web pages are illegal, and/or contravene morality and/or public order, they must immediately inform GLOBALMAR so that the access link to the same can be disabled, an action that will be carried out as soon as possible from the moment GLOBALMAR becomes aware of this circumstance.
In any case, the establishment of any type of link from the Website to another external web page does not imply that there is any type of relationship, collaboration or dependence between GLOBALMAR and the responsible of such external web page.
7.2. LINKS TO GLOBALMAR'S CHANNEL ON OTHER PLATFORMS AND SOCIAL NETWORKS
GLOBALMAR makes available to the users, through different tools and applications, link means that allow the users to access the channels and pages of the Website that GLOBALMAR maintains in different platforms and social networks belonging and/or managed by third parties (e.g. Facebook, Twitter, Linkedin). The inclusion of these links on the Website has the sole purpose of providing users with access to these channels on the different platforms and social networks.
The establishment of these applications does not imply the existence of any relationship between GLOBALMAR and the owner, manufacturer or distributor of the linked platform, nor the acceptance and approval by GLOBALMAR of its contents and/or services, being the owner, manufacturer or distributor the only responsible for them.
The activation and use of these applications may entail the identification and authentication of the user (login/password) in the corresponding platforms, completely external to the Website and out of GLOBALMAR's control. By accessing such external networks, the user enters an environment not controlled by GLOBALMAR, so GLOBALMAR will not assume any responsibility for the security settings of such environments.
For this reason, the user must exercise extreme caution in the evaluation and use of the information, contents and services existing in the linked channels, and on the information of his own or of third parties that he wishes to share in said channels.
7.3. LINKS ON OTHER WEB PAGES TO THE WEBSITE
GLOBALMAR does not authorize the establishment of a link to the Website from those pages that contain materials, information or contents that are illicit, illegal, degrading, obscene and, in general, that contravene the laws, morality or public order, or the generally accepted social norms.
In any case, users may establish links on their respective web pages directing to the Website, provided that they comply with the following conditions: a) the link may not reproduce the content of the Website or parts of it in any way; b) it is not allowed to create a browser or border environment over the Website sections, nor in any other way may the Website be modified; c) it is not allowed to make false or inaccurate or incorrect statements or indications about the Website and/or, in particular, to state or imply that GLOBALMAR has authorized the link or that it has supervised or assumed in any way the contents or services offered or made available in the web page where such link is established; d) the web page where the link to the Website is established will not contain illicit information or contents, contrary to morality and generally accepted good manners and public order, nor will it contain contents contrary to any third party rights, including intellectual and industrial property rights and/or the right to honor, to personal or family privacy or to the own image or any other right, or contents contrary to the rules regulating the protection of personal data.
GLOBALMAR has no power or human or technical means to know, control or approve all the information, contents, products or services provided by other web pages that have established links to the Website. GLOBALMAR does not assume any responsibility for any aspect related to the web page that establishes the link to the Website, specifically, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general.
8. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
GLOBALMAR is the owner or, if applicable, has the corresponding licenses on the exploitation rights of intellectual and industrial property of the Website, as well as of all the contents offered therein, including (but not limited to) the platform itself, texts, photographs or illustrations, logos, trademarks, graphics, designs, interfaces, or any other information or content, and the services available through the same.
References to registered trademarks or trade names, or other distinctive signs, whether owned by GLOBALMAR or third parties, imply the prohibition of their use without the consent of GLOBALMAR or their legitimate owners. At no time, unless expressly stated otherwise, the access, navigation or use of the Website and/or its contents does not grant the User any right over the distinctive signs included therein.
All intellectual and industrial property rights over the contents of the Website are reserved and, in particular, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute, by any means and under any form, all or part of the contents included in the Website, for public or commercial purposes, without prior, express and written authorization from GLOBALMAR or, if applicable, from the owner of the corresponding rights.
Likewise, it is forbidden to remove or manipulate the copyright indications or other credits that identify the holders of the rights of the contents that the User finds in the Web Site, as well as the technical protection devices, digital fingerprints, or any protection mechanism or information incorporated to the contents offered in the Web Site.
In the event that the User sends information of any kind to GLOBALMAR through any of the channels enabled for this purpose, the User declares, guarantees and accepts that he/she has the right to do so freely, that such information does not infringe any intellectual or industrial property right, trade secret or any other third party rights, and that such information is not confidential or harmful to third parties.
The User acknowledges assuming the responsibility, leaving GLOBALMAR harmless for any communication provided personally or in its name, reaching such responsibility without any restriction on the accuracy, legality, originality and ownership of the same.
If the User becomes aware of the existence of any illicit or illegal content, contrary to the law or that could imply an infringement of intellectual and/or industrial property rights, he/she must immediately notify GLOBALMAR through the e-mail address email@example.com so that it can proceed to the adoption of the appropriate measures.
Likewise, in the event that any User or third party considers that any of the contents of the Website owned by GLOBALMAR violates their intellectual and/or industrial property rights, as well as any other rights, they must send a communication to firstname.lastname@example.org with the following information:
· Identification data and means of contact of the claimant or his/her legal representative.
· Documentation proving your status as the owner of the allegedly infringed rights.
· Detailed account of the rights allegedly infringed by GLOBALMAR, as well as their exact location within the Website.
· Express declaration by the claimant that the use of the contents has been made without the consent of the owner of the allegedly infringed rights.
9. WEBSITE SUSPENSION
GLOBALMAR reserves the right to suspend, modify, restrict or interrupt, either temporarily or permanently, the access, navigation, use, hosting and/or downloading of the content, Products and/or use of services of the Website, with or without prior notice, without the possibility for the User to demand any compensation for this reason.
10. CONFIDENTIALITY AND DATA PROTECTION
GLOBALMAR may and reserves the right to modify the terms and conditions stipulated herein, in whole or in part, by publishing any changes in the same form in which they appear or through any type of communication addressed to the users.
To this effect, GLOBALMAR informs that it may inform and collaborate in due time with the competent police and judicial authorities if it detects any infringement of current legislation or if it suspects the commission of any crime.
13. APPLICABLE LAW AND JURISDICTION
Provided that the regulations in force provide for the possibility for the parties to submit to a specific jurisdiction, for any litigation arising from or related to this Web Site shall apply Spanish law in force at the time of the dispute, and we will submit to the Courts and Tribunals of Pontevedra.
